This Privacy statement (hereafter referred to as “Policy) is used by (i) PSV N.V., a nameless entity with a structure that conforms to Dutch law, registered with the Kamer van Koophandel (KvK) under registration number 17104199, statutorily established in Eindhoven (NL) with offices located at Frederiklaan 10A, 5616 NH, Eindhoven, (ii) PSV Stadionexploitatie B.V., a private entity with limited liability, registered with the Kamer van Koophandel (KvK) under registration number 17126009, statutorily established in Eindhoven with offices located at Frederiklaan 10A, 5616 NH, Eindhoven, (iii) The Eindhovense Voetbalvereniging Philips’ Sport Vereniging, registered with the Kamer van Koophandel (KvK) under registration number 40235615, statutorily established in Eindhoven with offices located at Frederiklaan 10A, 5616 NH, Eindhoven, (iv) Stichting PSV Foundation, registered with the Kamer van Koophandel (KvK) under restistration number 67779727, statutorily established in Eindhoven with offices located at Frederiklaan 10A, 5616 NH, Eindhoven (hereafter referred to collectively as “PSV” or “we”). In this policy we explain which personal data we collect about you and what we use it for. We also explain how you can modify your details as well as how you can enforce your right that your details not be modified in any way. This Policy applies to the modification by PSV of any details that identify you or that can be used to identify you (hereafter referred to as “personal details”) such as, but not limited to, the website psv.nl, the login functionality for psvfanstore.nl and psvsoccerschool.nl, https://tickets.psv.nl/nl/account/login, https://psv.pictures, the PSV App, the PSV Business App and the PSV payment card as offered by PSV (hereafter referred to as “Applications”) and the account that you use to register for access to the applications offered by PSV which are available at, among others, www.psvfanstore.nl/customer/account/login/ and https://www.psvsoccerschool.nl/bestellen/?action=account (hereafter referred to as “Account”).
  3. The Applications are offered to its clients by PSV (hereafter referred to as “Client”). This means that, with respect to the data processing in the applications, the client is “involved” as far as the General Data Protection Regulation (GDPR) is concerned regarding the personal data processed by the Applications, to the exclusion of PSV. This Policy is only intended to inform you about the processing of your Personal Data by PSV.
  4. PSV is the controller with respect to the GDPR if we process details from your account in order to provide services or if you provide us with personal details.
  5. PSV is entitled to make changes to this Policy at any time. If the Policy does change, the revised version will be published on the PSV website. Our primary goal regarding the collection of information is to improve the quality of your experience on our website. Therefore we only collect the information that we need to in order to achieve this goal. You are not required to provide us with this information and you can of course access all available resources on our website without having to provide us with any personal information.

Saved information
When you visit this website, we can collect and save the following information related to your visit:

  • your IP address or the IP address of your proxy server
  • the name of your Internet Service Provider (ISP)
  • the duration of your visit on our website
  • the number of times you have visited our website
  • basic information about your domain
  • the pages that you visited
  • the website that linked to our website
  • the website that you visit by following a link on our website

On some of the pages of this website, you are invited to provide your name and contact details for a mailing list or questionnaire, for example, or to register for an activity or a meeting or a membership. PSV gathers no other information about you besides that which you provide us, including personal details related to your membership (see the paragraph below). You consent to allow PSV to save any information that you provide. If you buy any product(s) from our website, we save the information related to these transaction. We can also save information about your purchasing habits. PSV retains your personal information as long as is necessary to be of service to you and to facilitate your use of our Applications.

On our website you can register to receive our newsletter. When you do so, we ask for your first name and e-mail address. At the bottom of each newsletter is a link you can follow to unregister from newsletters. Furthermore, you can fill in a contact form if you want us to contact you. In this case, we ask for your name, e-mail address and city of residence – you can also provide us with your telephone number if you want us to call you.

Use of personal details
PSV uses the information that is registered on this site for the following objectives:

  • to forward important information related to PSV activities and other requested information;
  • to forward important information related to PSV activities and other requested information;
  • to monitor the performance of this website;
  • to improve our website and services such as club news;
  • for internal administration and analytics;
  • to see which pages have been visited, study passive interests and further marketing objectives such as sending out product and service offers or news about events that might interest you based on your preferences.

Insight into or correcting your details
You can ask us about the personal information we have on you and request corrections. To do so, contact us at database@psv.nl.

By law and the relevant regulations, you can lodge a complaint with the data protection supervisor which affords you the following rights:

  • Dispute: Depending on the situation, you have the right to dispute the modification of your personal data and the circumstances under which that occurred.
  • Access: You have the right to be informed, at reasonable intervals, about the following i) when your personal information is modified, ii) the circumstances under which the modification(s) took place, iii) which categories of personal information were affected, and iv) who the recipients or categories of recipients were who received your personal information.
  • Modifying, deleting, blocking: Under certain circumstances, you have the right to allow your personal information to be improved, broadened, deleted or to have it screened off if it is factually incorrect, incomplete or irrelevant for the purpose or purposes of the processing or are processed, to any extent, in violation of a statutory provisions.
  • Notification: You have the right to receive notification from the parties that have received your Personal Data or whether your Personal Data has been corrected, expanded, deleted or protected as a result of your request. The foregoing applies unless such an action is impossible or requires an unreasonable effort on the part of a data controller.

If you request that PSV delete or block your personal information, the result could be that our Applications no longer work for you.

Retention period
Your personal information is retained no longer than is absolutely necessary with regard to the ability to modify it. The processing of your personal data is necessary for the execution of the agreement that PSV has with you when you use our Applications, or at least the permission you provide for the processing of your personal data for the various purposes as determined in this statement. We will no longer collect or process unless it is necessary to keep your data for longer in order to comply with a statutory obligation.

Sharing your data with third parties
Below you can see the organizations that PSV shares your personal information with.

Webshop software
Magento

Our webshop was developed with software from Magento. We have chosen The Badge Company B.V. for our web hosting. Personal data required for our services that you have given us is shared with this third party. The Badge Company B.V. has access to your information in order to be able to support us – they will never use your data for any other reason. The Badge Company B.V. is required to protect your data with appropriate security measures based on our agreement with them. The security measures include the use of SSL encryption and the enforcement of strong passwords. Backups are regularly made to ensure there is no data loss.

Web hosting
Hosting party

We use KPN Enterprise WebHosting (hereafter referred to as “KPN”) for our web hosting and e-mail services. KPN processes your personal data on our behalf and KPN does not use your data for any of its own purposes. This third party can, however, collect metadata about the use of its services. This is not personal data. KPN has taken appropriate technical and organizational measures to prevent the loss and unauthorized use of your personal data. KPN is obliged to protect your secrecy on the basis of our agreement.

E-mail and mailing lists
Communicator

We send out our newsletters using Communicator. Communicator will never use your name and e-mail address for its own purposes. At the bottom of each automated e-mail you will find an “unsubscribe” link. If you unsubscribe, you will no longer receive automated e-mails. You personal data is securely saved by Communicator. Communicator uses cookies and other internet technologies to determine whether an e-mail has been opened and read. Communicator retains the right to use your data to improve its services and in so doing it might share data with third parties.

Payment processors
Adyen

In order to process parts of payments in our webshop, we use the Adyen platform. Adyen processes your name, address, city and bank account and credit card details. Adyen has taken appropriate technical and organizational measures to protect your personal data.

Ayden retains the right to use your personal data in order to improve its services and in order to do so may share anonymized data with third parties. All the above-mentioned safeguards with regard to the protection of your personal data also apply to the parts of Adyen services for which they engage third parties. Adyen does not store your data for longer than is permitted by the legal terms.

Profiling tool
BlueConic

To create profiles for individual visitors, we use the online engagement software BlueConic. This software builds progressive visitor profiles by gathering data from multiple channels from the first anonymous visit up to and until you are a fully profiled client. This allows us to add you to segments and generate dynamic, relevant content in order to serve you better.

Online advertising
Facebook

We use a Facebook pixel on our website in order to send your online surfing behavior to Facebook. With the help of this pixel, we can launch campaigns that are relevant to your preferences and interests. Further, this makes it possible for us to launch social media campaigns targeted at other visitors that have similar preferences and interests to you.

Postal services
PostNL

If you order something from us, it is our responsibility to ensure that it is securely delivered to you. We use the delivery services of PostNL to send packages. It is therefore necessary for us to share your name, address, and city with PostNL. PostNL only uses this information in order to deliver packages to you. If PostNL has to use the services of a third party in order to deliver a package, PostNL will share this information with that third party only to the extent necessary.

Furthermore, PSV will not provide, sell, trade or otherwise make your personal data public under any circumstances unless:

  • you give us permission to do so;
  • we are required by law to do so.

Insight into, deleting or correcting your personal data
You can request to see which personal data we have about you free of charge. You can object to the processing of that data and you can request that we delete or correct your personal data. Contact PSV at database@psv.nl. We will respond to your request via e-mail within 4 weeks.

Furthermore, you have the right to lodge a complaint with the data protection supervisor regarding the processing of your personal data in case your request to us is not handled to your satisfaction.

Permission settings
PSV uses different techniques and methods to optimize your experience. You can select the authorization that suits you best. We offer the following three levels:

1. Basic website
At this level, no cookies are used except for those absolutely necessary. As a result, you use our default static website. There is no legal permission required to use these cookies and without these cookies the PSV websites will not function correctly. If you don’t want to accept these cookies, you can turn off cookies in your browser settings.

2. Optimized website
At this level, you agree to let us gather anonymous static information which you can use immediately or in the future in order to optimize the PSV website.

3. Dynamic website
At this level, you agree to let us gather personal information which you can use immediately or in the future in order to optimize the PSV website.

This website contains links to other websites. PSV is not responsible for the way in which these other websites treat your privacy. PSV recommends that you read the privacy statements of these linked websites because they could have different requirements and/or conditions that apply to you.

Safety
Various measures have been taken on this website to protect against the loss or misuse of, or unauthorized altering or consulting of, information that falls under our responsibility. However, information you send us is not encrypted, unless we explicitly state that it is.

Under age
If you are younger than 16, your parent or legal guardian must consent to the processing of your personal data as set out in this statement.

Applicable law and disputes
Dutch law is exclusively applicable and any dispute in connection with this Privacy Statement or the use of our Applications will be submitted to the Court of East Brabant located in ‘s-Hertogenbosch, Netherlands.
